Respondents PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents herein to regularize the services of the petitioner working as mazdoor with special time scale of pay and absorb him in regular time scale of pay from the date of initial appointment and consequently pay all monetary and attendant benefits.

The Petitioner joined as Mazdoor on 26.03.1999 and the time scale of pay was granted in his favour on 09.04.2012. Thereafter , the 2nd respondent has recommended the name of the petitioner for regularization on 13.03.2017. The proposal has been forwarded to the 1st respondent and it is still under consideration. Aggrieved over the same, the petitioner is before this Court.

2. Mr.Aruldoss, learned Additional Government Pleader takes notice for the respondents.

3. In the meanwhile, it is submitted that one of the similarly placed person approached this Court in W.P.No.4872 of 2020. This Court by its order dated 26.02.2020 has directed the https://hcservices.ecourts.gov.in/hcservices/

respondent to consider the representation of the individual and pass appropriate orders within a period of six weeks.

Learned counsel for the petitioner would submit that the case of the similarly placed person is favourably considered, but his representation has not been considered along with the similarly placed persons. Petitioner would be satisfied if the representation is considered along with the similarly placed person.

5. Considering the limited prayer, without expressing any opinion on merits, a direction is given to the 1st respondent to consider the proposal forwarded by the 2nd respondent in respect of the petitioner on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No costs.
