Criminal Miscellaneous Petitions filed under Section 389(2) r/w 482 Cr.P.C. to suspend the conviction and sentence imposed on the petitioner by judgment and order dated 13.04.2018 in C.C.No.211 of 2011 on the file of the Judicial Magistrate Court, Thiruvarur, confirmed by the judgment and order dated 24.07.2019 passed in C.A.No.18 of 2018 on the file of the Principal District-cum-Sessions Court, Thiruvarur and to exempt the petitioner from surrendering before the trial Court pursuant to the said judgments and orders, pending disposal of this criminal revision, respectively. ORDER

Since this is the case of concurrent findings of fact and taking into consideration the nature of allegations proved against the petitioner, this is not a fit case, in which, suspension of sentence and bail and exemption from surrendering can be granted. 2.

The petitioner is directed to surrender before the Judicial Magistrate, Thiruvarur and thereafter file a fresh application for suspension of sentence and bail.
