This application is filed by the applicant / defendant to condone the delay of 405 days in filing the written statement. This Court directed a better affidavit to be filed and the same has been placed on record.

Considering the averments made in the application and also taking into account, that the respondents / plaintiffs did not have any serious objection to this application being ordered and being satisfied with the reasons stated in the affidavit, this application is ordered. Consequently, the Registry is directed to receive the written statement of the defendant.

3. The Registry is directed to post the matter for framing of issues on 15.07.2023.
