JUDGMENT

(The Judgment of the Court was delivered by R.SUBRAMANIAN, J) The State ostensibly aggrieved by the direction issued by the Writ Court to implement the Ordinary Grade, Selection Grade and Special Grade scale of pay as per G.O.Ms.No.162, Finance Department, dated 13.04.1998 is on appeal.

2. The direction was made pursuant to the order of this Court in W.A.Nos.383 to 391 of 2009, dated 07.09.2009. The District Educational Officer, Chengalpattu, who is the appellant, has filed an additional affidavit stating that while this Court in WA.No.383 to 391 of 2009 had directed to implement the Ordinary Grade, Selection Grade and Special Grade scale of pay at the following rates:

Ordinary Grade Selection Grade Special Grade Rs.4000 - 5000 5000 - 8000 5500 - 9000 the Hon'ble Supreme Court in SLP.(C.A.)No.9560, etc., batch of 2019, vide its order dated 18.12.2019 had directed the grant of Ordinary, Selection and Special Grade Pay to Drivers as follows:

Ordinary Grade Selection Grade Special Grade 3200-85-490 4000-100-6000 4300-100-6000 The Government also by its letter dated 22.01.2020 bearing No.4866/CMPC/2013-2014, had instructed that the above scale of pay should be applied for Drivers in future.

3. In view of the said direction issued by the Hon'ble Supreme Court, nothing survives for consideration in this appeal. The appeal is therefore disposed of with a direction to the Government to comply with the orders of the Hon'ble Supreme Court referred to above in respect of the respondent also. As it is stated that the respondent is no more, the Government will calculate the benefits and pay to his Legal Heirs. No costs. Consequently, connected miscellaneous petition is closed.
