This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.T.Arockia Dass learned counsel for petitioners and Mr.R.Sagadevan for R1 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The parties have filed a joint memo of compromise dated 12.03.2022 duly signed by the respective parties and their respective counsel, which shall form part of this order.
2.Today, Mr.R.Kasi Viswanathan/R1 is represented by his son Mr.Velavan. His counsel, who is present before this Lok Adalat, has produced a copy of the order dated 04.03.2022 passed by the learned Single Judge of this Court in C.R.P.(PD).No.2422 of 2016, permitting Mr.R.Kasi Viswanathan to be represented by his son. A copy of the said order shall form part of this order. In lieu of the said order, counsel for R1 has filed a memo and recorded.
3. As per the memo of compromise, the matter is settled between the parties amicably in this civil revision petition. Accordingly, the suit relief in O.S.No.62 of 2014 pending on the file of the XVIII Assistant Judge, City Civil Court, Chennai is granted as prayed for, since the subject matter of the suit in O.S.No.62 of 2014 itself is taken up and disposed off in this National Lok Adalat, the Court below is directed to record this award and close the suit. The Sub Registrar concerned is directed to act according to this award.
4. By virtue of the said compromise, Mr.Velavan has today received three Demand Drafts Nos.426616 to 426618 drawn on Canara Bank, Thiruvotriyur in favour of the 1st respondent totalling for a sum of Rs.2,50,000/- and also received cash of Rs.50,000/- before this Lok Adalat.
5. In view of the above Joint Compromise Memo, this Civil Revision Petition is disposed off.
This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid, less 5%, shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
