ORDER

This writ petition has been filed, challenging the impugned order dated 22.09.2025 passed by the respondent, rejecting the petitioner's application seeking for issuance of Patta in her name for the property, morefully disclosed in the prayer to this writ petition on the ground that the subject property is Government land.

2.The petitioner has challenged the impugned order on the ground of violation of principles of natural justice and on the ground that it is a nonspeaking order. The petitioner categorically contends before this Court that she is the absolute owner of the property and she is in possession of the same. She claims that by virtue of the sale deed of the year 2010, she became the absolute owner of the property and she continues to be in possession of the property till date.

3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondent.

4.As seen from the impugned order, the contentions of the petitioner as raised in this writ petition have not been considered by the respondent and the petitioner was also not afforded any opportunity of hearing prior to the passing of the impugned order.

5.Being an order passed in violation of principles of natural justice and being a non-speaking order, necessarily, the impugned order dated 22.09.2025

passed by the respondent has to be set aside by this Court and the matter has to be remanded back to the respondent for fresh consideration, on merits and in accordance with law.

6.Accordingly, the impugned order dated 22.09.2025 passed by the respondent is hereby quashed and the matter is remanded back to the respondent for fresh consideration, on merits and in accordance with law. The petitioner is directed to submit a written explanation along with the supporting documents to the respondent stating as to how she is entitled for the issuance of patta in her name, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said written explanation from the petitioner within the stipulated time, the respondent shall pass final orders, on merits and in accordance with law, after giving due consideration to the written explanation submitted by the petitioner as well as the supporting documents produced by her and after hearing all the necessary parties on the petitioner's application seeking for grant of Patta in her name for the subject property, within a period of eight weeks thereafter.
