Kovai B.Jayaraman (Died) v. Sri Kannikaparameswari

CMP.246/2009 in S.A.2217/2003 KBKVJ This petition is filed to implead the wife and two sons of the deceased first appellant by name Kovai B.Jayaraman as the appellants 3 to 5 in the Second Appeal.

In my considered view, when the suit, arising out of which is the present Second Appeal, is filed by the appellants in the representative capacity on behalf of the particular community, the question of impleading the legal heirs of one of the deceased appellants does not arise herein. As the Second Appellant/2nd Plaintiff is already on record. There is no impediment for him to pursue the remedy in this Second Appeal.

With the above observation, This miscellaneous petition is dismissed.
