ORDER

This petition has been filed to permit the petitioner to implead the proposed second respondent, namely Cairo Engineering, the registered owner of the vehicle bearing Registration No. TN-19-AX-4374 having address at No.378, Bharath Nagar, Pudupattinam, Kalpakkam, Chengelpat District - 603 102 as the second respondent in the above Criminal Revision Case.

2. The learned counsel appearing for the petitioner submitted that as per the amendment made to the Tamil Nadu Motor Vehicles Accidents Claims Tribunal Rules, 1989, whenever a vehicle involved in an accident and when such vehicle does not have a valid insurance policy, such vehicle should not be returned to the owner. Further, if the vehicle remains in the custody of the Court for more than three months, the same has to be sold and the sale proceeds have to be deposited before the Motor Accident Claims Tribunal. It is further submitted that the owner of the vehicle must be heard in this regard. Therefore, the proposed second respondent, being the registered owner of the vehicle, is a proper and necessary party to the proceedings.

3. The learned Government Advocate (Crl.Side) appearing for the first respondent has no serious objection for impleading the proposed second respondent.

4. In view of the above submission made by the learned counsel appearing on either side, the Crl.M.P.No.4751 of 2026 is allowed.

5. The Registry is directed to carry out the necessary amendment in the Criminal Revision Case.
