ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.01.2026 for the alleged offences punishable under Sections 103(1) of BNS, 2023 in Crime No.18 of 2026 on the file of the respondent police, seek bail.

2. The case of the prosecution is that following a pathway dispute in an agricultural field, the petitioner assaulted the deceased with a wooden log, causing him to succumb to his injuries

3. The learned counsel appearing for the petitioner submitted that the petitioner also sustained grievous injuries on his fore head, as he was attacked by the deceased with Koduval. He also relied on the medical report that the petitioner was admitted to the hospital and treated for the injuries sustained on his forehead. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner was arrested only on 25.01.2026. The learned Government Advocate (Crl.Side) also produced the postmortem report reveals that the deceased sustained more than 21 injuries including a stab wound, whereas the petitioner sustained only cut injuries on his forehead. This shows that the petitioner attacked the deceased indiscriminately with a wooden log and other weapons. He further submitted that investigation is still in progress. Hence, he opposed to grant bail to the petitioner.

4. Heard both sides and perused the materials available on record.

5. Though it is stated that the petitioner also sustained injuries, considering the nature of the allegations, the fact that the petitioner is in judicial custody since 25.01.2026 and that the investigation is still pending, this Court is

of the view that if the petitioner is released on bail, at this stage, it may hamper the investigation, even though the petitioner has no bad antecedents. Therefore, this Court is not inclined to grant bail to the petitioner.
