Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the respondents 4 and 5 to consider and pass orders on the proposal submitted by the petitioner on 10.07.2015.

Heard Mr.M.N.Kathir, learned counsel appearing for the petitioner and Mr.R.Rajeswaran, learned Special Government Pleader, accepting notice on behalf of the respondents. By consent, the writ petition is taken up for final disposal at the admission stage itself.

2.The petitioner has filed this writ petition praying for issuance of writ of mandamus to direct the respondents 4 and 5 to consider and pass orders on the proposal submitted by the petitioner on 10.07.2015.

3.The petitioner vide the said proposal has requested for payment of sale consideration, for purchase of his land, at the rates as per the guideline value. It appears that the Palladam Municipality has passed a resolution on 14.07.2015 agreeing to purchase the land at the rate of Rs.10,00,000/- (Rupees Ten Lakhs Only) per acre. The said resolution along with the proposal has been forwarded by the fifth respondent Municipality to the fourth respondent.

4.In the light of the above, there will be a direction to the fourth respondent, to consider the representation given by the petitioner and inform the petitioner as to what is the stage of the matter and if the fourth respondent is convinced with the stand taken by the fifth respondent Municipality, appropriate proposals/recommendation may be made to the second respondent for taking decision in this matter. The above direction shall be complied with by the fourth respondent within a period of three months from the date of receipt of a copy of this order. No costs.
