ORDER

Seeking a direction to the respondent to conduct fresh investigation, order for alteration of charges of offence and to file fresh charge sheet in Crime No.214 of 2013 on the file of respondent, the petitioner has come up with this petition. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent and perused the material placed on record.

3.It appears that on a complaint lodged by the petitioner, a case in Crime No.214 of 2013 was registered on 01.09.2013 for offences under Sections 147, 294B, 323, 427 and 506(i) IPC against 6 named persons and 5 unnamed persons. The police completed the investigation in Crime No.214 of 2013 and filed a final report against 11 persons. The defacto complaint was not satisfied with this and he wants further investigation because, according to him, the police have left out certain other persons. The fact remains that in the FIR, totally 6 named persons and 5 unnamed persons were registered which amount to 11. Now, the final report has been filed against 11 persons. The defacto complainant cannot include other persons to improve his case now and then, by asking for further investigation.

In the result, this Criminal Original Petition is dismissed, as it is devoid of merits.
