Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to provide police protection tot he petitioner in respect of removal of all trees fall on the carriageway and passage of the petitioner on northern side by putting iron wire fence on south side by putting gate on eastern side in respect of the property situated at Ramakonagipatti Village, Senthamangalam Village, Namakkal District comprised in Survey No.300/4D1, 300/7A, 300/10A, 300/11A.

This Writ Petition has been filed seeking police protection based on the representation given by the petitioner on 7.3.2024. 2.Learned Government Advocate (Crl.Side), on instructions, submitted that, based on the representation given by the petitioner, petition enquiry is pending in CSR No.100/2024, on the file of the 3rd respondent Police. 3.The 3rd respondent while dealing with the representation, shall take into consideration the decree that was passed n O.S.No.561 of 1977, AS.No.78 of 2006 and also the order that has been passed by the Execution Court in E.A.No.450 of 2013 in E.P.No.90 of 2013, wherein police protection was ordered. 2/4
4. The petitioner is directed to co-operate with the Police for enquiry and the respondent Police shall conduct the enquiry keeping in mind the judgment in Lalitha Kumari vs. Government of Uttar Pradesh reported in 2013 (6) CTC
353. On completion of the enquiry, the respondent Police shall take a decision regarding the further course of action. This process shall be completed by the respondent Police within a period of two weeks from the date of receipt of copy of this order.
