O R D E R

The prayer in the present petition is to grant parole the petitioner's brother J.Pratheep, S/o. Jayapandian, aged about 27 years, confined in Puzhal Prison II High Security Block II for a period of 3 days for attending his father's funeral ceremony on tomorrow i.e 06.03.2018.

2. Heard Mr.F.Camilus Selva, learned counsel appearing for the petitioner and Mrs.Kritika Kamal.P, learned Government Advocate (Crl.Side) appearing for the respondents.

3. It is submitted that the petitioner's brother, who is confined in Puzhal Prison -II High Security Block II, Chennai, has lost his father today and the funeral is scheduled to be held on 06.03.2018 at 11 a.m . Taking into account that the

remand prisoner is the son of the deceased, it would be appropriate to release him on parole for a period of three days, commencing from 05.03.2018 (today).

4. Hence there shall be a direction to the first respondent to release the remand prisoner namely J. Pratheep, S/o. Jayapandian, who is confined in Puzhal Prison-II High Security Block II, Chennai on parole, enabling him to attend the funeral of his father Jayapandian at No.8, I Cross Street, Thanikachalam Nagar, Ponniammanmedu, Chennai -110 on the following conditions;

1. The remand prisoner shall be released on parole from 05.03.2018 to 08.03.2018.

2. On the aforesaid three days, the second respondent shall ensure that the remand prisoner is taken back on each day at 7 p.m to the M-1, Madhavaram Police Station, Madhavaram, Chennai and kept in custody therein and be sent on parole at 6.a.m on the subsequent day.

3. On completion of the 3rd day i.e., on 08.03.2018 at 7 p.m, the first respondent herein shall ensure that the remand prisoner is taken back to Puzhal Prison -II High Security Block II, Chennai.

4. The second respondent shall also provide necessary escort to the remand prisoner during the entire parole period of 3 days.

With the above observations and directions, the Criminal Original Petition stands disposed of.
