Prayer in both W.Ps.: Writ Petitions filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent herein to treat the petitioner herein as belonging to Schedule Tribe community for the purpose of recruitment in Group II for the year 2013-14 under Registration No. 270718039 and Group-I for the year 2013-14 under Registration No.270119016 respectively and grant appointment to the petitioner to the said post under reserved quota for Schedule Tribe. In both W.Ps.

Ms.C.M.G.Niraimathi Special Government Pleader COMMON ORDER The petitioner applied for the post of Group - I as well as Group - II services. There is a dispute with regard to his community status. He has filed these two writ petitions seeking for a direction to the respondent to treat him as Schedule Tribe candidate for the recruitment purpose in Group-I and Group-II services.

2. When the matter came up for admission on 05.06.2015, this Court passed the following order:- https://hcservices.ecourts.gov.in/hcservices/

"The petitioner applied for Group II as well as Group I services. His community status was in dispute. However, the same was resolved by the Tamil Nadu State Level Scrutiny Committee by its order dated 26.02.2015. Thereafter, he was issued a community certificate by the competent authority that he is a Schedule Tribe. Now, he has filed these two writ petitions seeking for a direction to the respondent to treat him as belonging to Schedule Tribe community for the purpose of recruitment in Group II as well as Group I services, for which he applied. Hence, the petitioner is permitted to serve notice to the learned counsel for the Tamil Nadu Public Service Commission.

Post the matter on 12.06.2015 in the motion list."

3. Today, the learned counsel for the Tamil Nadu Public Service Commission, appeared.

4. I have heard both sides.

5. In view of the aforesaid facts, a direction is issued to the respondent to treat the petitioner as Schedule Tribe candidate for the purpose of recruitment in Group-I and Group-II Services.

6. These two Writ Petitions are disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
