Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 2nd respondent, namely, District Registrar, Tirupur and 3rd respondent, namely, The Sub-Registrar, Udumalaipettai, to issue certified copy of the Partition Deed registered as Document No.1323 of 1966.

Mr.P.P.Purushothaman, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a Mandamus, directing the respondents 2 & 3 to issue certified copy of a Partition Deed, registered as Document No.1323 of 1966.

4. It is stated that the petitioner by way of his application dated 07.12.2018, requested the 3rd respondent to furnish the certified copy of the Partition Deed dated 30.04.1966, registered as Document No.1323 of 1966 at the office of the 3rd respondent.

5. The grievance of the petitioner is that the 3rd respondent has neither returned the application nor furnished the certified copy of the Partition Deed so far, despite two reminders issued by the 1st respondent to the 2nd respondent.

6. Needless to say that when an application is filed seeking for furnishing the certified copy of the Partition Deed, the 3rd respondent has to consider such application and pass appropriate orders, without keeping the same pending endlessly. Therefore, this writ petition is disposed of, only by directing the 3rd respondent to consider the application filed by the petitioner dated 07.12.2018 and pass orders on the same on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
