ORDER

The petitioner, who apprehends arrest for the alleged offence under Section 420 of IPC, in Crime No.78 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant owned four lorries and that A1 and A2 (the petitioner herein), had taken away the lorries belonging to the defacto complainant and when the same was questioned by the defacto complainant, they threatened him with dire consequences. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner/A2 along with A1 had entered into an agreement with the defacto complainant to lease the lorries belonging to the defacto complainant to A1 and A2 and that A1 had also paid one-month instalment and that the present complaint has been lodged only due to a business dispute between the defacto complainant and A1 and A2. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner has been involved in four other similar cases in Crime Nos.394 of 2025, 60 of 2026, 78 of 2026 and 83 of 2026. Hence, he opposed the grant of anticipatory bail to the petitioner/A2.

5. Thus, considering the criminal antecedents of the petitioner, as the petitioner every time misused the liberty granted to him, this Court is not inclined to enlarge the petitioner on bail at this juncture.
