O R D E R

This petition is filed to modify the order dated 29.04.2017 passed by the Principal sessions Judge at Puducherry in Cr.M.P.No.967 of 2017 in Crime No.66 of 2017 and direct the Chief Judicial Magistrate Puducherry to return the passport on further conditions passed by this Hon'ble Court.

2. The learned Public Prosecutor (Puducherry) submitted that the petitioner has involved in three offences and in connection with one of the case he is already deposited his passport before the learned Chief Judicial Magistrate, Puducherry.

3. It is brought to my notice that the petitioner is a French National and that since the investigation is pending it would not be appropriate to permit the petitioner to leave the country. In view of the fact that the petitioner has already surrendered his passport before the the learned Chief Judicial Magistrate, Puducherry, I do not think that any modification need to be made in the present petition. However, since the learned counsel for the petitioner submitted that the case have been foisted against the petitioner and that he intend to go back to his country, it would be appropriate to direct the respondent police to complete the investigation as expeditiously as possible.

4. In the result the prayer sought for in the petition is rejected. However the respondent police is directed to complete the investigation in Crime No.66 of 2017 and file a charge sheet/final report within a period of three months from the date of receipt of a copy of this order.

5. Accordingly this criminal original petition stands disposed of with the above observations.
