Respondents PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the respondents to give a police protection to the petitioner herein based upon his complaint dated 10.07.2015, when the Petitioner visit Sub Court, Kallakurichi to attend his civil cases O.S.Nos.124 of 2011 and 140 of 2012 and also give protection to visit his property without fear of life.

ORDER

The apprehension of the petitioner is that since the respondents 4 and 5 have threatened him, he is unable to attend the civil cases in O.S.No.124 of 2012 and 140 of 2012 before the Sub-Court, Kallakurichi.

2. Today, when the matter was called, the learned Additional Public Prosecutor, on instructions, submitted that the third respondent police is willing to extend police protection to the petitioner as and when he attends the Sub Court, Kallakurichi. The learned counsel for the respondents 4 and 5 have also submitted that the respondents 4 and 5 have no intention to threaten the petitioner.

3. Recording the said submission, the Criminal Original Petition is disposed of with liberty to the petitioner to approach the third respondent, seeking for protection.

4. On receipt of such representation, the third respondent is directed to extend adequate protection to the petitioner, while he attends the civil cases in O.S.No.124 of 2012 and O.S.No.140 of 2012, before the Sub Court, Kallakurichi.

With these observation, the Criminal Original Petition is allowed.
