ORDER
By order dated 04.02.2026 in Crl.A.No. 60 of 2026, this Court imposed a condition requiring the petitioner/appellant to appear before the trial court on
the first working day of every week at 10.30 am until further orders. The petitioner has filed this Criminal Miscellaneous Petition seeking to relax the said condition.
2.Learned counsel for the petitioner submits that this Court, vide order dated 04.02.2026, was pleased to allow the appeal in Crl.A. No. 60 of 2026 and granted bail on condition that the petitioner shall appear before the trial court on the first working day of every week at 10.30 am until further orders. He further submits that the petitioner has complied with the said condition from 09.02.2026 without fail. He further submits that the case was altered to include offences under the SC/ST (POA) Act after a delay of seven years from the date of occurrence. Consequently, the petitioner was arrested on 28.11.2025 for an incident that allegedly occurred on 28.11.2017, and he remained in custody for 70 days. As the second respondent has now completed the investigation and the final report is ready for filing, no useful purpose would be served by requiring the petitioner to continue complying with the aforementioned condition.
3. Learned Government Advocate (Crl. Side) appearing for the official respondents has no objection to the modification sought by the petitioner.
4. In view of the above and considering the submissions made by the learned counsel for the petitioner, as well as the fact that the investigation has
been completed, this Court is of the considered view that the prayer sought by the petitioner may be acceded to.
5. Accordingly, the condition imposed on the petitioner in Crl.A. No. 60 of 2026, vide order dated 04.02.2026, requiring him to appear before the Trial Court on the first working day of every week at 10:30 a.m. until further orders, is hereby modified. The petitioner shall now appear before the Trial Court on the first working day of every English calendar month at 10:30 a.m., effective from 01.04.2026, and thereafter, on such days as may be fixed by the learned Trial Judge.
