Respondent Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, Directing the respondent to return the Tipper Lorry Ashok Leyland make bearing Registration No.TN 30 AT 4743 to the petitioner based on the representation dated 21.01.2015 forthwith. For Petitioner : Mr.C.Prabakaran For Respondent : Mr.N.Roofus Abraham Government Advocate.

O R D E R

By consent, the writ petition is taken up for final disposal.

2. The petitioner claims that he is the permanent resident of the address contained in the writ petition and that the Ashok Leyland Tipper Lorry bearing Regn.No.AP 04 W 0914, was originally purchased by one Govarthanarao Maram, who was the resident of Vijayawada in the State of Andhra Pradesh and it was plying within the said State with all relevant records and subsequently, the petitioner has purchased the said vehicle on 14.09.2014, through proper means and subsequently, applied to the Regional Transport Officer of the Vijayawada for issuance of No Objection Certificate to register the vehicle in the State of Tamilnadu and on getting the necessary permission, the vehicle was also re-registered as TN30 AT 4743 and the Registration Certificate, has also been issued by the concerned official to that effect and the petitioner was plying the said vehicle.

The petitioner would further state that he parked the vehicle at Petrol Bunk near Valapaadi Bus Stand on 15.01.2014 and on the next day, it was missing and the petitioner on enquiry came to know that the vehicle has been seized by the respondent. The petitioner, in this regard, approached the respondent on very many times, to know about the reason for seizure of the vehicle and also https://hcservices.ecourts.gov.in/hcservices/

submitted a representation on 21.01.2015, praying for return of the vehicle and since, he has not been favoured with any response, came forward to file this writ petition.

4. Heard the submissions of Mr.C.Prabakaran, learned counsel appearing for the petitioner and Mr.N.Roofus Abraham, learned Government Advocate, who accepts notice for the respondent.

Though, the petitioner has sought for a larger relief, this Court on the facts and circumstances of the case and without going into the merits of the claim projected by the petitioner, directs the respondent to consider the representation dated 21.01.2015 submitted by the petitioner, on merits and in accordance with law, after giving him an opportunity of personal hearing and pass orders as expeditiously as possible and not later than four weeks from the date of receipt of a copy of this order and inform the decision taken, to the petitioner.
