This application has been filed seeking leave to sue the defendants who are residing outside the jurisdiction of this Court. 2.The suit has been filed seeking declaration of title with respect to Item Nos.1 to 6 of the suit schedule property as described in the plaint and for permanent injunction restraining the 1st, 2nd and 3rd defendants from enjoying the rent paid by 4th to 9th defendants in respect of Item Nos.1 to 4 of the suit schedule properties and also for further injunctions. There is also a relief sought relating to Settlement Deed, which had been executed and it is claimed that they are null and void and unenforceable.

3.Among the properties described in the schedule to the plaint, Item Nos.5 to 9 are situated outside Chennai. Additionally, 1st, 2nd, 3rd and 10th defendants are residing outside the jurisdiction of this Court. 4.It is under these circumstances, leave is sought. Since substantial part of cause of action had arisen within the jurisdiction of this Court, leave is granted. Accordingly, this application stands allowed. 5.The Registry may proceed to number the plaint if it is otherwise in order.
