O.A.No.416 of 2024 & A.No.3991 of 2024 C.S.No.134 of 2024 O.A.No.416 of 2024 has been filed seeking an order of interim injunction restraining the Respondents/Defendants 1 to 3 and their men and agents or any person claiming under them from claiming any right in the suit schedule properties or creating any encumbrance and from entering into the Suit schedule properties and disturbing the peaceful possession of the Applicant/Plaintiff in running the business viz., Lakshmi Holiday Inn, Kotagiri in Item 5 of the suit schedule property, pending disposal of the above Suit.

2.A.No.3991 of 2024 has been filed to vacate the interim injunction granted in O.A.No.416 of 2024 in C.S.No.134 of 2024 dated 24.06.2024 on the file of this Court.

3.Heard the learned counsel for the Applicants and the learned counsel for the Respondents.

4.In view of the fact that the document filed in the Plaint was not furnished along with Order XXXIX Rule 3(a) of CPC., notice, and hence, interim order already granted by this Court on 24.06.2024 is not extended. It is further clarified that O.A.No.416 of 2024 is hereby dismissed. Consequently, A.No.3991 of 2024 is also closed.
