ORDER

This Writ petition has been filed for issuance of writ of mandamus directing the respondent police to consider the representation made by the petitioner on 19.03.2022 and consequently return back the jewel that was recovered in the course of investigation in Crime No.178 of 2008.

2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing on behalf of the respondents.

3. The petitioner gave a complaint to the respondent police on 10.04.2008 to the effect that 11 sovereigns of gold jewel was stolen from the petitioner. Based on the complaint, an F.I.R. Came to be registered in Crime No.178 of 2008. According to the petitioner, the jewel was recovered and it was not returned back to the petitioner. Hence, the representation was made to the respondent police. Since there was no response, the writ petition has been filed before this Court.

4. Learned Government Advocate on instructions submitted that 2/4

after registration of the F.I.R., there was no recovery of any gold jewellery and a closure report was filed before the learned Judicial Magistrate, Ponneri on 25.11.2019 as 'Further action dropped'. It was therefore contended that there is no question of returning back the jewellery which was never seized / recovered.

5. In the light of the stand taken by the respondent police, no further orders can be passed in this writ petition. Accordingly, the same is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
