ORDER

This Criminal Original Petition has been filed seeking to quash the First Information Report for the petitioner in Crime No.1088 of 2021 on the file of the Respondent Police.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. On perusal of the FIR in Crime No.1088 of 2021 dated 31.10.2021, this Court is of the view that prima facie allegation is made out. Therefore, the contention raised by the learned counsel for the petitioner is only in factual aspects. The same requires appreciation of evidence and it cannot done at this stage.

4. In view of the above, this Court does not find any merits in this petition. Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petition is closed. Further, the respondent police is directed to file the final report as expeditiously as possible preferably within a period of two months from the date of receipt of a copy of this order.
