ORDER
The petitioner, who was arrested and remanded to judicial custody on 25.09.2025 for the alleged offences under Sections 8(c) and 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.458 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 25.09.2025, based on secret information, the respondent police intercepted a vehicle driven by the petitioner
and seized 100 kgs of ganja from the vehicle. Hence, the case was registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been in incarceration since 25.09.2025 and is only a driver and had no knowledge about the contraband. It is further submitted that this is the third bail application. Hence, he prayed for granting bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that huge quantity of 100 kgs of ganja was recovered from the vehicle driven by the petitioner and therefore the rigour under Section 37 of the NDPS Act is attracted.
5. I have given anxious consideration to the submission of the learned Government Advocate (Crl. Side).

Considering the submission of the learned counsel on either side, this Court is of the view that the petitioner along with other accused was found with 100 kgs of ganja, which is commercial quantity, the rigour under Section 37 of the NDPS Act would squarely applies. Therefore, this Court does not find any material either in the petition or in the submissions of the learned counsel for the petitioner to overcome the statutory bar. Hence, this Court is not inclined to enlarge the petitioner on bail.
