Senthilkumar ...Respondent Prayer: The Criminal Revision petition is filed under Section 397 and 401 of Cr.P.C to call for the records pertaining to the order dated 25.07.2016 passed in S.T.C. No.17 of 2015 on the file of Judicial Magistrate (Fast Track Court), Omalur and set aside the same and consequently direct the Judicial Magistrate (Fast Track Court), Omalur to take the case on file and proceed further and disposed according to law.

ORDER

This Criminal Revision Petition No.81 of 2018 has been filed against the order of learned Judicial Magistrate in S.T.C. No.17 of 2015 on the file of Judicial Magistrate (Fast Track Court), Omalur.

2. It is seen from the order of the Trial Court that bailable warrant was ordered against the respondent on payment of process fee. However, process fee had not been paid and there was no representation on the complainant side. Therefore, the learned Judicial Magistrate, dismissed the complainant under Section 204(4) of Cr.P.C for non-payment of process. In order to give one more opportunity to the petitioner to prosecute the case, this Court is of the considered view that this petition may be allowed on payment of costs of Rs.3,000/- (Rupees Three Thousand only) to the respondent on or before 07.01.2021 failing which, this Criminal Revision Petition will stand dismissed automatically. The above said amount has to be deposited in Judicial Magistrate (Fast Track Court), Omalur. https://hcservices.ecourts.gov.in/hcservices/

3. Accordingly, this Criminal Revision Petition is disposed of subject to the aforesaid condition.
