JUDGMENT

This Criminal Appeal is filed to call for the records in C.C.No.2072 of 2017 on the file of the XX Metropolitan Magistrate Court, Allikulam, 1/4

Chennai - 3 and set aside the Judgment dated 12.02.2021 in the interest of justice.

2. When the matter was taken up for hearing, the learned counsel for for the appellant submitted that the respondent had passed away on 27.03.2024 thereby sought permission of this Court to withdraw this appeal with liberty to the appellant to file a civil suit before the competent civil Court. An endorsement to the said effect was also made by the learned counsel for the appellant in the appeal today.

3. In view of the submission made by the learned counsel for the appellant, this Criminal Appeal stands dismissed as withdrawn with the liberty as sought for by the learned counsel for the appellant. 17.04.2024 rap Index : Yes/No Speaking order : Yes/No NCC : Yes/No 2/4
