The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 467, 468, 471, 477(A), 120(B), 408 and 420 of IPC in Crime No. 3 of 2022, seeks anticipatory bail.

2. It is stated that the petitioner had been taken into custody on 24.11.2022. He then filed an application seeking bail. An interim bail was granted on condition that the petitioner should deposit a sum of Rs.5/- lakhs to the credit of the society, where the petitioner was working and who was the defacto complainant.

3. The grievance of the petitioner was that there were other accused and when they sought anticipatory bail, the condition imposed was for them to deposit a sum of Rs.1/- lakh. Claiming that the petitioner C.V.KARTHIKEYAN , J.

Crl.O.P.No.6857 of 2023 vsg has been singled out to deposit Rs.5/- lakhs, whereas the other accused was directed to deposit a sum of Rs.1/- lakh, the petitioner filed a modification application. That particular application again came up before the learned Single Judge, who modified the order to a sum of Rs.1/- lakh. The petitioner should therefore deposit the said sum of Rs.1/- lakh. He had only deposited a sum of Rs.40,000/-. Since the condition to deposit a sum of Rs.1/- was not complied with, the bail granted stood automatically cancelled to the petitioner.

Now, the petitioner seeks anticipatory bail which cannot be granted and the petitioner will have to comply with the order of depositing a sum of Rs.60,000/- and he should seek extension of time from the Court which modified the order. This Anticipatory Bail Petition is not maintainable and hence, this Criminal Original Petition is dismissed.
