O R D E R

The criminal original petition is filed for a direction to the Special Court for Trial of Cases under SC & ST (PoA) Act, Salem to consider the bail application of the petitioner in Crime No. 58 of 2026 on the file of the 2nd respondent on the same day of filing.

The allegation against the petitioner is that on 31.01.2026, he along with other accused, had trespassed into the property of the de facto complainant and damaged the fence and the shed put up by her. When the de facto complainant questioned the same, she was assaulted and abused in filthy language, besides threatening and humiliating her by calling her caste name, which resulted in the filing of the complaint. 3.

The contention of the petitioner is that he has been falsely implicated and he has no connection, whatsoever, with the alleged occurrence. He was not present at the place of occurrence and there are no specific allegations against him in the complaint. The petitioner has been included as an accused without any material to show his involvement. 4.

Heard the learned Additional Public Prosecutor and perused the materials on record.

The petitioner is stated to be an adjacent land owner of the de facto complainant. The de facto complainant owns 1300 sq.ft of property in Maramangalathupatti, Omalur Taluk. On the date of occurrence, the petitioner along with others is said to have trespassed into the property of the de facto complainant, damaged the fence and shed put up in the property, besides abusing the de facto complainant using unparliamentary words and uttering caste related words.

In view of the above factual position, there shall be a direction to the Special Court for Trial of Cases under SC & ST (PoA) Act Salem to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.58 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
