Judgment (Judgment of the Court was delivered by S.M.Subramaniam J.) The present intra Court Appeal has been instituted to quash the order dated 20.12.2022 passed in Review Application No.114 of 2019 in W.P.No.10434/2004.
2. The appellant was employed in Indian Bank and removed from service on 23.03.1993 in a department disciplinary proceedings. The appellant preferred W.P.No.10434 of 2004 and the said writ petition was dismissed by the learned single Judge on 01.03.2013. Admittedly, no appeal has been filed against the final order passed in the writ petition. However, the appellant preferred a Review Application which was also dismissed by the learned single judge on 20.12.2022.
3. Pertinently, the order of removal was passed in the year 1993 and the writ petition itself was filed in the year 2004, after a lapse of 11 years from the date of removal of appellant from service. Th writ petition was dismissed on 01.03.2013 and the review application was numbered after six years from the date of dismissal of the writ petition, by order dated 01.03.2013. There is consistent delay in each proceedings and that apart, the final order in the writ petition remains unchallenged.
4. For all these reasons, the appellant is not entitled for any further relief. Consequently, the Writ Appeal stands dismissed. No costs. (S.M.S.,J.) (N.S.,J.) 03-06-2026 Index: Yes/No Speaking/Non-speaking order vsi To
