ORDER

This Criminal Original Petition has been filed to direct the Principal District Sessions Judge, Namakkal (Special Court for SC/ST, PoA Act Cases) to consider the petitioners bail application on the same day of their surrender in connection with Crime No.93 of 2026, registered by the 2nd respondent.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 & 2.

3. Considering the submissions and on perusal of the materials available on record, it is seen that the 1st petitioner, through Tamil Matrimony, had married the 3rd respondent / defacto complainant. The defacto complainant had earlier married one Parthasarathy, who later died and thereafter she registered herself with Tamil Matrimony. The 1st petitioner had projected himself as an unmarried person and married the 3rd respondent. The 1st petitioner lived with the defacto complainant for some time for his lust and thereafter left for his native place and did not return. Subsequently, the 3rd respondent went to the village of the 1st petitioner and found that he was already married and had children. By suppressing the said fact, he had deceived the defacto complainant and spoiled her life.

4. Further, it is alleged that she was threatened and driven out by both the petitioners. The 2nd petitioner thereafter followed the defacto complainant to her house, demanded sexual favours and abused her by calling her by her caste name.

5. In view of the above, there shall be direction to the Principal District and Sessions Judge, Namakkal (Special Court for SC/ST, PoA Act Cases) to consider the bail application of the petitioners preferably on the same day of their surrender in connection with Crime No.93 of 2026.
