ORDER
The petitioner, who was arrested and remanded to judicial custody on 05.02.2026 for the alleged offences under Sections 419, 420, 465, 467, 468, 471, 380 r/w. 34 of IPC [ sections 319, 318, 336, 338, 340, 305 r/w. 3(5) of
BNS Act], in Crime No.18 of 2026 on the file of the respondent police, seek bail.
2. The case of the prosecution is that the petitioner had created a forged documents by impersonating the defacto complainant and sold the property to a third party in the year 2006. Hence, the present case.
3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been in custody since 05.02.2026 and is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police strongly opposed the grant of bail on the sole ground that the petitioner was arrested only on 05.02.2026 and the investigation is in the preliminary stage and it is a case of impersonation. Hence, he opposed to grant bail to the petitioner.
5.Considering the fact that it is a case of impersonation and that the investigation is in the nascent stage, this Court is of the view that it is not
desirable to enlarge the petitioner on bail at this juncture. Accordingly, this Criminal Original Petition is dismissed.
