ORDER

Writ petition has been filed seeking for the issuance of a writ of Mandamus to direct the respondents to furnish the information sought in the

application of the petitioner dated 13.02.2017. 2.The petitioner has sought for certain information under the Right to Information Act from the respondents by way of an application dated 13.02.2017 and communication dated 20.02.2017. The respondent University has informed that the petitioner has sought for third party information and therefore, reply from the concerned third party is unwarranted and is contrary to the settled legal position as well as against the principles of natural justice. Hence, no information is given.

3.The learned counsel for the respondent University submitted that on non furnishing of information, the petitioner is entitled to file an appeal. Therefore, without exhausting the appeal, the writ petition cannot be maintained. The learned counsel also submitted that in the event of the petitioner making an appeal for furnishing of information, in the light of the information as stated under Section 19 of the Right to Information Act, 2005, the information will be provided to him within a period of one week from the date of application.

4.In view of the above, the petitioner is directed to make an appeal as per Section 19 of the Right to Information Act within a period of two weeks from the date of receipt of a copy of this order. On such appeal being made, the

respondent University is directed to provide information within one week thereafter.
