Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 1013 days in filing the appeal and thereby render justice.(CMP.NO.9618/2021) Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.V.RAGHAVACHARI, Advocate for the petitioner and of MR.D.RAVICHANDER, GOVERNMENT COUNSEL for the 1st Respondent and of MR.GIRISSH, Advocate for the 2nd Respondent, the court made the following order:- [Order of the Court was made by M.M.SUNDRESH, J.] The petitioner is the claimant/appellant. This appeal has been preferred against the award passed by the Reference Court in L.A.O.P.No.6 of 2010. Seeking to condone the delay of 1013 days in filing the appeal, the present petition has been filed.
2. Learned counsel appearing for the petitioner submitted that the appeal could not be filed due to the ill health of the counsel leading to miscommunication.

3. Learned counsel appearing for the second respondent submitted that the delay is huge and the petition is required to be dismissed.
4. This appeal has been filed by the claimant and, therefore, we are inclined to consider it so as to facilitate a decision on merit as what is sought for is only an enhanced compensation. Taking note of the substantial number of days delay in filing, the delay is condoned and this petition stands allowed on condition that the petitioner pays a sum of Rs.3,000/- (Rupees Three Thousand only) as costs to the Tamil Nadu State Legal Services Authority, High Court, Madras, within a period of two weeks from today. -sd/- 05/08/2021 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
