The application is filed to condone the delay of 98 days in filing the restoration application in C.S.No.657 of 1997.

2. Despite service of notice, the respondents have not filed any counter and neither any objection is made today before the Court.

3. I have gone through the affidavit, filed in support of the application and I am satisfied with the reasons assigned in the affidavit, filed in support of the application.

4. In order to afford a fair opportunity to the applicant to prosecute the suit, the delay is required to condoned.

5. Accordingly, the delay is condoned and the petition is allowed.

6. Registry is directed to list the restoration application, if it is otherwise in order.
