Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to survey the land and lay the boundary stone to the petitioner's land situated in Survey Numbers 510/9, 510/10, 511/2H, 511/2F, 511/2G and 511/2C at Siruvapuri Sri Balasubramaniya Swami Nagar, Thozhuvoorkuppam Village, Sevapet, Tiruvallur District to the total extent of 8295 sq.feet as per the applications of the petitioner dated 28.12.2018.

Mr.B.Anandan, learned Government Advocate takes notice for the respondent. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

The petitioner seeks for a mandamus directing the respondent to survey the land and lay the boundary stone to the petitioner's land situated in Survey Numbers 520/9, 510/10, 511/2H, 511/2F, 511/2G and 511/2C at Siruvapuri Sri Balasubramaniya Swami Nagar, Thozhuvoorkuppam Village, Sevapet, Tiruvallur District, measuring to the total extent of 8295 sq.feet, based on her application dated 28.12.2018.

It is stated that the petitioner has purchased the above said lands by way of sale deeds dated 11.11.2011 vide Document Nos.13842/2011, 13843/2011, 13844/2011 and 13841/2011, bearing Patta Numbers 4323, 4307, 4299 and 4321. It is further stated that the petitioner is in possession and enjoyment of the above said lands from the date of purchase. It is further stated that the petitioner made an application to the respondent on 28.12.2018, seeking to survey the above https://hcservices.ecourts.gov.in/hcservices/
said lands and lay boundary stone. The grievance of the petitioner is that the said application has not been considered by the respondent so far. Hence, the present writ petition.

This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the respondent to consider and pass appropriate orders on the same on merits and in accordance with law. Thus, this writ petition is disposed of, only with a direction to the respondent to consider the application of the petitioner 28.12.2018 and pass appropriate orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
