ORDER

This Writ Petition has been filed challenging the order passed in Cr.M.P.No.1613 of 2024 in Spl.C.C.No.18 of 2015 on the file of the Chief Judicial Magistrate/Special Judge, Erode dated 23.02.2024, thereby rejecting the request made by the petitioner to produce the document no.2 under Section 91 Cr.P.C., 2.The petitioner is an accused facing trial in Spl.C.C.No.18 of 2015 under Section 7 and 13(2) r/w 13(1)(d) of Prevention of Corruption Act. Pending trial, the petitioner already filed CMP.No.1466 of 2008 for production of two documents by the respondents, which was allowed. One document was already marked as Ext.P19, insofar as the second document is concerned, it is from the Office of the Block Development Officer, Thalavadi Panchayat. However, it was not produced by the Block Development Officer. While that being so, once again the petitioner has filed a petition seeking for the very same documents before the trial Court, which has been dismissed vide the impugned order.

3.It is noted that the whereabouts of the said document sought for by the petitioner is not known and no circumstance arose to produce the said document. That apart, the entire trial is over and the matter is posted for arguments.

4.In view of the above, this Court finds no infirmity or illegality in the impugned order. Therefore, the Criminal Original Petition is dismissed.
