ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.11.2025 for the alleged offences under Sections 318, 190 of BNS, 2023 @

318(4) r/w. 3(5) of BNS Act and section 21(1), 21(2), 21(3) of the Banning of Unregulated Deposit Schemes (BUDS) Act, in Crime No.28 of 2025 on the file of the respondent police, seek bail.

2. The allegation against the petitioner is that the petitioner was running a Chit fund company and misappropriated Rs.10 crores from 150 victims. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is aged about 58 years and that he has been in incarceration since 25.11.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Public Prosecutor (Puducherry) appearing for the respondent police reiterated the prosecution case and submitted that total amount involved is Rs.10 crores and so for no amount has been recovered. Hence, he opposed to grant bail to the petitioner.

5. Taking into consideration the gravity of the allegations and their impact on society, this Court is of the view that if the petitioner is enlarged on bail it may have a negative impact on society in respect of such type of

offences. Hence, this Court is not inclined to enlarge the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed. 10-03-2026 MPA To
