(The case has been heard through video conference) Since, it had been represented by the learned counsel for the petitioner as the matter is urgent, the matter is numbered and it is taken up for hearing today through video conference.

2. The case was called twice. There is no representation for the petitioner and the learned counsel for the petitioner is called absent. Heard the learned Additional Public Prosecutor representing the respondent.

3. This petition has been filed seeking to direct the respondent to register a case based on the petitioner's

complaint dated 11.05.2020 and to investigate the case in accordance with law.

4. Mr.K.Prabhakar, learned Additional Public Prosecutor appearing for the respondent would submit that the complaint has been given only on 11.05.2020. The complaint is given by the employer as against the erstwhile employee alleging that he is spreading falsehood and rumors against the complainant company and the complaint disclosed offences of non cognizable nature. He would submit that the case has been registered as CSR.No.498 of 2020 on the same day.

5. This Court perused the petition and the documents annexed along with the petition. The petitioner has preferred the complaint dated 11.05.2020 against the erstwhile employee alleging that he had sent E-mails making baseless and false allegations to tarnish the image of the company. The complaint has been given only on 11.05.2020 and it has been taken up for enquiry in CSR.No.498 of 2020. Even without waiting for the preliminary enquiry or without approaching the superior officials, the petitioner has rushed to this Court.

In the opinion of this Court, in view of the order passed by the Division Bench of this Court in Crl.O.P.(MD) No.13681 of 2018 and the batch of cases dated 20.09.2018, this petition is not maintainable. Therefore, this petition is liable to be dismissed, with liberty to the petitioner to work out his remedy as per the directions given by the Division Bench of this Court.

7. With the above directions, this Criminal Original Petition stands dismissed.
