Petition under Article 226 of the Constitution of India praying for issue of a Writ of Habeas Corpus directing the 3rd respondent herein to grant leave to the petitioner's husband, the detenu Babu S/o. Kesavan, 32 years ( C.P. No. 14998 ) confined in Central Prison, Coimbatore as a life convict for a period of two months on the ground of Corona Virus threat pursuant to the representation sent by mail to the 1st respondent on 08.04.2020 and to the 2nd and 3rd respondents on 04.04.2020. The petitioner's husband, who is a life convict is undergoing imprisonment in Central Prison, Coimbatore. The https://hcservices.ecourts.gov.in/hcservices/
petitioner gave a representation on 08.04.2020 through email to the 1st respondent for grant of two months leave for her husband owing to the present pandemic threat as there is possibility of her husband getting infected inside the prison. The said representation was not considered which compelled the petitioner to approach this Court by way of this Habeas Corpus Petition. 3.
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents. 4.
Considering the limited scope of the Habeas Corpus Petition, this Court directs the 1st respondent to consider the petitioner's representation dated 08.04.2020 and pass orders on the same, on merits and as per law, within a period of two weeks from the date of receipt of a copy of this order. 5.
With the above direction, the Habeas Corpus Petition is closed.
