O R D E R

The present Writ Petition has been filed seeking a direction to the 1st respondent to consider the petitioner's representation dated 15.12.2014 for cancellation of patta issued in favour of the 4th respondent in respect of the subject of the subject property.

2. It is the case of the petitioner that the patta has been wrongly issued in favour of the 4th respondent in respect of the petitioner's property. Hence, the petitioner made a representation dated 15.12.2014 before the 1st respondent seeking to cancel the patta which was issued in favour of the 4th respondent. However, the same has not been considered so far. Hence, the petitioner has come before this Court by filing the Writ Petition.

3. Learned counsel for the petitioner submits that this Court may issue a direction to the 1st respondent to consider the petitioner's representation dated 15.12.2014 and pass appropriate orders on the same within the time that may be stipulated by this Court.

4. On the above contention, this Court heard the learned Government Advocate appearing for respondents 1 to 3 and perused the materials available on record.

5. As per the provisions of the Patta Passbook Act, Tahsildar is the competent Authority to cancel the Patta which was already issued, however, the petitioner has made a representation to the 1st respondent/District Revenue Officer, who is not competent to cancel the Patta. In such view of the matter, this Court permits the petitioner to make a fresh representation to the 3rd Respondent/ Tahsildar along with the copy of this order, within a period of two

(2) weeks from the date of receipt of a copy of this order. If any such representation is made, the 3rd respondent is directed to consider the said representation and pass appropriate orders on the same in accordance with law, after affording an opportunity of personal hearing to the petitioner as well as the aggrieved persons if any, within a period of four (4) weeks thereafter.

6. This Writ Petition stands disposed of with the aforesaid direction. No Costs.
