Respondents PRAYER This criminal original petition is preferred under section 528 of the BNSS 2023 seeking to call for the entire records in pursuant to the First Information Report in Crime No.189 of 2013 dated 25.07.2013 pending on the file of the 1st Respondent Police and quash the same and to pass such other orders as this Hon'ble Court may deem fit and proper to the circumstances of the case and thus render justice.

ORDER

This criminal original petition has been filed by the petitioners seeking to quash the FIR registered in Crime No.189 of 2013, dated 25.07.2013 on the file of the first respondent police.

2.Heard the learned counsel for the petitioners. Mr.Leonard Arul Joseph Selvam, learned Additional Public Prosecutor appearing for the first respondent submitted that in this case investigation has been completed and charge sheet has been filed vide LTN No.20230003227 [C202500001], dated 06.01.2025. At this stage, the learned counsel for the petitioners seeks permission of this court to withdraw this criminal original petition with a liberty to challenge the charge sheet. The learned counsel has also made an endorsement in the case bundle to this effect. The same reads as follows:

'I may be permitted to withdraw the CrlOP No.7012/2026 with a liberty to challenge charge sheet'.

3.The said endorsement is recorded. In view of the same, this criminal 2/4

original petition is dismissed as withdrawn with liberty to the petitioners to challenge the charge sheet in a manner known to law. No costs. Consequently, connected miscellaneous petition is closed.
