ORDER
This writ petition has been filed for the issue of writ of Mandamus directing the respondents 1 to 2 to consider the representation made by the petitioner on 30.12.2024 on the ground that the Rumble Strips that are erected in the highways are not as per the norms and that it causes health issues and it also affects the mechanics of the vehicle.

Heard M/s.P.Bhuvaneswari, learned counsel for the petitioner and Mr.E.Veda Bagath singh, learned Special Government Pleader for Respondents 1 and 2.

It is seen from records that the representation that was made by the petitioner was already dealt with by the Divisional Engineer and through communication dated 17.12.2024, the petitioner was informed that such rumble strips has been laid strictly in line with the IRC(Indian Roads Congress) 352015.

After the above communication was given by the Divisional Engineer, once again the petitioner has submitted a representation before the 1 st respondent and since the same was not considered, the present writ petition has been filed before this Court.

In the considered view of this Court, the present writ petition is more in the nature of a public interest litigation. The petitioner is a road user and is aggrieved by the fact that the rumble strips that are erected in the Highways is causing health issues and affect the mechanics of the vehicle. This issue does not confine itself only to the petitioner and it involves public interest. Therefore, if at all the petitioner is aggrieved, only a public interest litigation can be filed in this regard. Apart from that, the petitioner has already been informed by the Divisional Engineer that such rumble strips has been laid in line with the IRC guidelines. Hence, no useful purpose will be served in giving the representation to the Sub Collector in this regard since that authority cannot decide this issue.

In view of the above, the relief as sought for by the petitioner cannot be granted by this Court and it is left open to the petitioner to work his remedy in the manner known to law.
