Prayer: The Criminal Revision petition is filed under Section 397 r/w 401 of Cr.P.C against the Judgment dated 15.12.2016 made in C.A.No.215/2015 on the file of the Court of the III Additional District and Sessions Judge, Coimbatore modifying the order dated 08.09.2015 made in D.V.A.No.42 of 2013 on the file of the Court of the Judicial Magistrate No.VII, Coimbatore. ORDER

The Revision petition is filed against the Judgment dated 15.12.2016 made in C.A.No.215 of 2015 on the file of the Court of the III Additional District and Sessions Judge, Coimbatore, which was filed challenging the order dated 08.09.2015 passed by the Judicial Magistrate No.VII,Coimbatore in D.V.A.No.42 of 2013.

2. Originally this petition was filed under Section 12 of the Protection of Women from Domestic Violence Act seeking relief residence order Under Section 19(F) of the said Act and to pay a sum of Rs.5,00,000/- as compensation under Section 22 of the said Act and to pay Rs.10,000/- as maintenance under Section 20(3) of the said Act. .

3. It appears that in D.V.A.No.42 of 2013 the learned Judicial Magistrate No.VII, Coimbatore directed the petitioner to pay Rs.7,000/- per month as maintenance.Against the same, the petitioner filed C.A.No.215 of 2015 on the file of the Court of the III Additional District and Sessions Judge, Coimbatore and the Court modified the maintenance amount with a direction to pay Rs.3,000/- per month as maintenance.

4. It is now reported by the learned counsel for the petitioner and respondent that during the pendency of this revision petition the matter has been settled by the parties. The learned counsel for the petitioner prays for dismissal of this petition as infructuous.

3. His submissions is recorded and this petition is dismissed as infructous. Consequently, the connected miscellaneous petition is closed.
