Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the second respondent to consider the representation of petitioner dated 27.6.2016 to instruct the first respondent police to remove the petitioner name from the history sheet in their police station.

ORDER

The relief sought for in this writ petition is to direct the second respondent to consider the petitioner's representation dated 27.06.2016 and to instruct the first respondent police to remove his name from the history sheet. 2.According to the petitioner, he is doing real estate business and is not a habitual offender. In the case in Cr.No.889 of 2002 registered against him, he was acquitted from the charges and that, all other petty cases were also closed. However, due to vengeance, the police officials noted his name as habitual offender, under the influence of some local politician and real estate persons. That apart, the first respondent again registered FIRs in Cr.Nos.264/2013 and 1407/2013 against the petitioner for the offence under section 307 IPC and without filing charge sheet, they called him and https://hcservices.ecourts.gov.in/hcservices/

subjected him to harassment. Feeling aggrieved, the petitioner made a representation dated 27.06.2016 to the first respondent requesting to remove his name in the history sheet, which was not considered, till date. Therefore, this writ petition. 3.Heard both sides and perused the materials placed before this court.

4.Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this court, without going into the merits of the case, directs the first respondent to consider the representation of the petitioner dated 27.06.2016, if not considered earlier, and pass appropriate orders, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5.Accordingly, this writ petition stands disposed of. No costs.
