ORDER

This Writ Petition has been filed seeking for the issuance of a Writ of Mandamus, to direct the respondents 2 to 9 to consider the representation of Tirupur Industrial Wastewater Recycling Company Limited dated 06.03.2018 and remove the name of the petitioner from the list of defaulters maintained by the second respondent.

2.The case of the petitioner is that the petitioner is one of the Directors of Tirupur Industrial Wastewater Recycling Company Limited (in short 'TIWRCL'), which was formed for implementation of Zero Liquid Discharge (ZLD) facilities for 69 industrial units at Tirupur in order to make them pollution free. In that process, the petitioner's Company obtained loan from various banks and the same was settled on 16.12.2014. However, the second respondent declared the petitioner's Company as defaulter in their Website. For removal of the name of the petitioner's Company, the petitioner made a representation before the second respondent on 06.03.2018. Since the same was not considered, the present Writ Petition is filed before this Court for appropriate directions.

3.The learned counsel for the petitioner would submit that, it would suffice, if this Court issues a direction to the second respondent to remove the 3/6

name of the petitioner's Company in the defaulters list after securing the information from other banks, in which, one time settlement was made by the petitioner's Company by considering his representation dated 06.03.2018 within the time frame that may be fixed by this Court. 4.The learned Counsels appearing for the respondents 3 and 4 to 9 would submit that already the petitioner's Company-TIWRCL cleared the loan amounts. As on date, there is no due by the petitioner's Company to the banks. 5.In view of the above submissions, this Court directs the second respondent to secure information from all the banks and consider the representation of petitioner dated 06.03.2018 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. 6.With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 08.03.2023 Index : Yes / No Speaking order / Non-speaking order sp 4/6
