(Crime No.416 of 2025) ... Respondent PRAYER : Criminal Original Petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, Act, 2023, to enlarge the petitioner on anticipatory bail in the event of his arrest in Crime No.416 of 2025 pending investigation on the file of the respondent police. For Petitioner : Mr.A.Vijayakumar For Respondent : Mr.P.Dhileepan, Government Advocate (Crl.Side)
ORDER
The petitioner apprehends arrest for the alleged offence under Sections 126(2), 296(b), 115(2), 118(1), 324(2), 351(3) of BNS, in Crime No.416 of 2025 on the file of the respondent police seeks anticipatory bail. 1/4
2. The allegation against the petitioner is that, due to previous enmity, the petitioner joining hands with the other accused, attacked the de facto complainant and his father with a knife and an iron rod, thereby caused severe injuries. Hence, the case.
3. The learned counsel for the petitioner submitted that due to a family dispute, the case has been registered against the petitioner and that the injured has been discharged from the hospital. He further submitted that the petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is having 13 previous cases, including a case under 307 IPC. Hence opposed to grant anticipatory bail to the petitioner.
5. I have given anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record. 2/4
6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has bad antecedents of 13 previous cases, this Court is of the view that, in these type of cases, if the petitioner is enlarged on anticipatory bail, it may embolden him to indulge in similar acts. Hence, this Court is of the view that the petitioner does not deserve the grant of anticipatory bail.
7. Accordingly, this Criminal Original Petition is dismissed. 17.03.2026 cda To 1.The Inspector of Police, Kottakuppam Police Station, Villupuram District.
2.The Public Prosecutor, High Court of Madras.
