The petitioner has filed the above Writ Petition to issue a writ of mandamus directing the 1st respondent to consider the petitioner's statutory appeal dated 29.09.2014 and pass orders within a time frame.
2.Ms.P.T.Rama Devi, learned counsel appearing for the petitioner submitted that though the petitioner has filed the appeal, challenging the order passed by the 2nd respondent issuing patta in favour of the 3rd respondent, as early as on 29.09.2014, the 1st respondent has not disposed of the same yet. 3.Ms.A.Madhumathi, learned Special Government Pleader appearing for the respondents 1 & 2 submitted that the 1st respondent may be directed to dispose of the appeal within a https://hcservices.ecourts.gov.in/hcservices/
period of twelve weeks, after giving an opportunity of hearing to the petitioner as well as to the 3rd respondent. 4.Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for in the Writ Petition, without expressing any opinion with regard to the merits of the case, I direct the 1st respondent to dispose of the appeal dated 29.09.2014 filed by the petitioner, on merits and in accordance with law, after giving an opportunity of hearing to the petitioner as well as to the 3rd respondent, within a period of twelve weeks from the date of receipt of a copy of this order.
5.With these observations, the Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
