PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to pass an order of Direction, directing the second respondent and his men not to harass the petitioner's family except by due process of law.

ORDER

This Petition has been filed seeking direction to the Police not to harass the Petitioner's family except by due process of law.

2. Learned Government Advocate submitted that, as on date neither a case nor a petition is pending against the petitioner.

3. According to the submission of the learned counsel for the petitioner, the police is unnecessarily harassing the petitioner. However, the learned Government Advocate submits that no case or petition is pending against the petitioner and the question of harassment does not arise at all. https://hcservices.ecourts.gov.in/hcservices/

4. Having regard to the above fact, this Court is not inclined to pass any blanket Order directing the police not to harass the petitioner. However, if any complaint is filed against the petitioner, it is for the police to make proper enquiry. In such a case, the petitioner shall co-operate with the respondent police and the police shall enquire the petitioner without harassing him. Further, it is made clear that this order shall not be shield for the petitioner against the arrest.

5. With the above direction, the Criminal Original Petition is disposed of.
