Respondents PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to pay the special provident fund and leave salary (Earned and Unearned Leave) payable to the Petitioner within a time limit stipulated by this Court and further direct the Respondents to pay interest to his at the rate of 12 percentage per annum from 01.05.2018 till the actual date of payment.

Petitioner has sought for payment of Special Provident Fund and leave salary (Earned & Unearned Leave) within a stipulated time along with interest for that purpose he made a representation to the respondents on 18.01.2021 same is pending disposal. Hence, the present writ petition has been filed.

2. Mr.M.Loganathan, Additional Government Pleader takes notice for the respondents.

3. It is well settled by very many judgmenst that the benefits which are sought for by the petitioner is earned by him during his service and therefore he is entitle to the same. https://hcservices.ecourts.gov.in/hcservices/

4. However, without expressing any opinion on merits, a direction is given to the respondents to dispose of the petitioner's representation dated 18.01.2021 on merits and in accordance with law within a period of four weeks from the date receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No costs.
